At the close of plaintiffs case the Trial Justice dismissed Chemicals cross claim against the co-defendant Blackstone Corp. (Blackstone) without permitting Chemical to offer proof in support of the cross claim. At the close of the entire case Chemicals cross claim against the third-party defendant Freight Container Security, Inc. (FCS) was dismissed.
